| Abstrakt | Der Antrag befasst sich mit transnationaler Regulierung irregulärer Migration. Ziel des Antrages ist einerseits durch Erhebung von Daten in drei unterschiedlichen Ländern eine profunde Kritik an den normativ theoretischen Grundlagen transnationaler Rechtstheorie darzulegen. Andererseits soll die Forschung über das kritische Potential hinausgehen und die Auswirkungen auf Staats-/EU-Bürgerschaft einer solchen transnationalen Regulierung aufzeigen. Das primäre Forschungsobjekt ist somit nicht die primär Normbetroffene (irreguläre Migranten), sondern Staats-/EU-Bürgerinnen. Die Auswirkungen von transnationaler Regulierung irregulärer Migration wirkt sich vor allem negativ auf letztere aus. The project’s main purpose is to review the transnational migration controls and its normative effects on the concept of citizenship. Over the last two decades, developed countries in particular increased the amounts spent on migration controls in order to constrain irregular migration. The newest trend in these expenditures is to outsource and shift such control measures to territories of developing countries. As a result, borders have ceased to be geographic lines on a map, becoming instead reconceptualized as flows, meeting irregular migrants where their journey starts: in countries of origin and transit.
Based on two arguments, the present research contributes to a major shift in international legal scholarship: First, it argues that it's not merely migration controls that shift territorially, but legal norms and institutions also migrate from developed to developing countries. Second, these irregular migration controls do not merely affect irregular migrants, but also have negative impacts on the concept of citizenship in the regulating countries. This research specifically analyzes the migration of legal norms and institutions from the EU, South Africa and the USA (developed countries) to Morocco, Mozambique and Mexico (developing countries), respectively. | |
